122 - RFP Development of Vacant Residential Lots

End date: Wednesday December 17, 2014 at 2 p.m.

A. Introduction

The City of Springfield is requesting proposals for the redevelopment of various residential properties. The City is seeking proposals that will redevelop and enhance the existing vacant lots. The City will entertain all offers. For specific information on individual properties including street and parcel identification number, address, current use and minimum bid see Attachment A-Property Listing.

B. Environmental Issues, Property Conditions & Restrictions

Any and all properties are being sold "as is" and the City makes no representations regarding the structural or environmental conditions. The selected developer accepts the properties "as is" with no exception. All new construction is required to go through Site Plan Review by the City Office of Planning and Economic Development. Approval of new construction will be at the sole discretion of the City of Springfield.

The following development conditions will apply to the below listed properties:

• 244 Locust Street (07860-0053): The City will not be considering proposals for development and/or new construction at this property. Only accessory and/or green-space uses will be considered.
• 258 Locust Street (07860-0056): The City will not be considering proposals for development and/or new construction at this property. Only accessory and/or green-space uses will be considered.
• 188 Locust Street (07860-0040): The City will not be considering proposals for development and/or new construction at this property. Only accessory and/or green-space uses will be considered.
• SS Locust Street (07860-0038): The City will not be considering proposals for development and/or new construction at this property. Only accessory and/or green-space uses will be considered.
• ES Morton Street (08860-0060): Development will be contingent on any and all approvals from the Department of Public Works and may include development of Morton Street.
• ES Saint James Avenue f/k/a 95 Saint James Avenue (11170-0401): Under current zoning the development of the parcel is limited to single family development. Any development more than a single family will require a variance from the Zoning Board of Appeals.

Abutters that purchase vacant lots for additional parking, green space and/or accessory uses will be required to legally combine the lot with their existing property to create one parcel, unless an exception is allowed by the City.

The City has not made and does not make any representation or warranty as to any matter affecting or relating to the property, including but not limited to the physical condition thereof, and the selected developer acknowledges that no such representation or warranty has been made and agrees to take the property in "as is" condition on the date of this agreement. The City shall not be liable or bound in any manner by any statement, representation, or information pertaining to the property which may have been furnished to the developer by any of the City's employees, attorneys, agents, servants, or other persons.

C. Additional Information

A review committee will be established to review complete proposals and will be composed of representatives from the Springfield Planning Department, Office of Housing, City Treasurer, Economic Development Department and neighborhood representatives.

The Committee may, in its sole and absolute discretion, reject any and all, or parts of any and all proposals; may re-advertise this RFP if so inclined; postpone or cancel at any time this RFP process; change, adjust, or modify the anticipated schedule of events. The Committee further reserves the right to waive any minor informalities pertaining to any proposals received. The determination of the criteria and process whereby proposals are evaluated, the decision as to who will receive preferred developer status, or whether or not an award shall ever be made as a result of this RFP shall be in the sole and absolute discretion of the City.

If a nonprofit organization is chosen preferred developer, it will be expected to enter into an agreement with the City to make an annual in-lieu-of-tax payment, the amount of which will be calculated as follows:

(Assessed Value Per Thousand) x (Tax Rate) x (Fifty Percent)

The proposer selected shall make the annual payment in lieu of tax payment commencing in the fiscal year of the closing and all subsequent fiscal years.

This Request for Proposals is for the real property only. All contents of the property and any personal property therein may not be included in this sale at the discretion of the City of Springfield.

All bidders are buying property subject to all current zoning and building restrictions. Changes to the use of the property may require a variance. The City makes no representations regarding success of variances and/or specials permit applications.

The City of Springfield has made all efforts to ensure that the information is accurate. However, it is the buyer's responsibility to investigate to their satisfaction any matter as it may relate to the property.

D.Submission Deadline

COMPLETE SUBMISSION PROPOSALS MUST BE RECEIVED BY DECEMBER 17, 2014 AT 2:00 P.M. by

The submission package proposal must be submitted as follows:

Proposer's name, address, phone and fax number marked on the outside of eight (8) envelopes, each marked "Request for Proposal for Redevelopment of Various Vacant Parcels - Per Bid No. 15-122". One (1) unbound original proposal and seven (7) bound copies of the proposal must be submitted simultaneously in eight (8) separate envelopes.

E. Pre-Proposal Assistance

Assistance in the completion of a submission including any assistance in assembling a development team and/or financial analysis cannot be provided.

In order to provide prompt answers to questions, the Chief Procurement Officer requests that all proposers submit written questions one week prior to the RFP response deadline. Accordingly, questions must be received in writing only at the City of Springfield, Office of Procurement not later than December 3, 2014. Questions may be faxed or emailed. The Office of Procurement fax number is (413) 787-6295 or email to Lauren Stabilo, CPO at lstabilo@springfieldcityhall.com . The Procurement Office will compile written answers which will be mailed back to all Proposers who requested a copy of the RFP, no later than December 10, 2014.

To maintain a fair and impartial competitive process, the Procurement Office can only answer written questions. Please avoid private communication with any RFP Committee Member from the release date through the selection of Preferred Developer. Proposers who initiate private communication or attempt to violate the process outlined herein may be disqualified.

F. Submission Evaluation Criteria

1. Minimum Evaluation Criteria

Minimum Requirements will be used as a general guide to evaluate and rank the proposals include, but is not limited to, the following:

• Qualifications of the Proposer and Development Team;
• Compatibility with the surrounding neighborhoods and Downtown,
• Adequacy of management plan;
• Financial feasibility;
• Extent to which public funding is minimized;
• Adequate work program and project schedule;
• Merits of the Proposer's Conceptual Development Plan;
• Compatibility, connectivity and integration with the surrounding context (e.g., activities, structures, facilities, etc);
• The Proposer's plans for mitigating the impacts upon transportation, utilities, the environment, etc. caused by the proposed project; and
• Commitments, financial incentives or regulatory waivers requested of the City by the Proposer, which must be clearly stated in the proposal.

In addition, proposals must include the following information for the subject site as it applies to the proposed reuse:

• Design feature of housing unit (if applicable);
• Conceptual illustration of landscaping of the entire site;
• General description of an approach to lighting to lessen the use of light poles, bright lights and glare as seen from abutting properties, yet allows for pedestrian safety.

Acceptable proposals will be judged in accordance with the following Comparative Evaluation Criteria.

1) Developer Capability
2) Project Feasibility
3) Achievement of Public Policy Goals
4) Readiness to Proceed

G. Anticipated Schedule of Events

The anticipated schedule, which is in the discretion of the City and can be modified, is as follows:

H. Submission Requirements

Responses must contain three basic components.
Specifically, properly executed forms including:

A. Request for Proposal Form Completed and Signed
B. Tax Certification Affidavit, Signed and Notarized
C. Non Collusion/Fraud Statement
D. Disclosure of Beneficial Interests
(Forms for items A-D are provided with the RFP package.)
E. A bid with a minimum offer as detailed in Attachment A

The City of Springfield supports the goal of twenty percent minority and women participation in all contracts. No questions will be answered unless received by the Chief Procurement Officer at least 7 days prior to the expiration of the time set for submitting bids or proposals. The Chief Procurement Officer reserves the right to waive any informality in and to reject any or all bids if it is in the public interest to do so.
