14-155 - Purchase and Redevelopment of East Side Hayden Avenue and 870 State Street

The City of Springfield (hereafter "CITY") is requesting proposals for the redevelopment of two tax foreclosed parcels on State Street and Hayden Avenue, as more fully described in "Section D. Location and site information" of this Request for Proposals (RFP).

The Redevelopment Project site includes two separate parcels situated on approximately 1/2 acre (22,284 square feet) of land at a high point on the State Street Corridor, overlooking the City to the west of Mason Square. The site has frontage along State Street. Although the information regarding the property contained in the RFP is from sources deemed reliable, such information has not been verified and no representation is made or implied as to its accuracy.

The City will require the developer whose proposal includes the purchase and redevelopment of both parcels as a single project, individual proposals for the two separate site packages will not be considered. Please see Section D as "State Street - Project in bid specifications.

The City will appoint a Review Committee to review all proposals and recommend finalists. "Sections K - M" and Attachment B in the RFP outlines the evaluation criteria the Review Committee will utilize to review qualifications and rank the finalists. The City and the appointed Review Committee reserve the right to reject any or all proposals in whole or in part for any reason and to waive any minor informalities within proposals or this document.

The two properties are being sold "as is" and the City makes no representations regarding the environmental and/or physical condition of the properties and will require the buyer to assume responsibility for these conditions. Prospective developers should undertake their own reviews and reach their own conclusions concerning zoning, title and survey matters, required approvals, physical conditions, environmental conditions, reuse potential, utility services and development, leasehold, legal and other considerations. Proposers are responsible for making their own determinations of existing conditions.

The site's two properties are located in the Bay neighborhood along the edge of Mason Square. The properties are all located along the 3.2-mile-long State Street Corridor which recently underwent a $16 million restoration project, including roadway reconstruction, intersection improvements, new sidewalks and median strips and many new pedestrian and vehicle amenities. The reconstruction is a key factor in advancing redevelopment opportunities along the State Street Corridor.

Downtown Springfield is approximately a 1.5 miles to the west, and Springfield Technical Community College Enterprise Center is located about 1 mile to the west. Western New England University, MassMutual Life Insurance and the Baystate Health Complex are all located within a 2 ½ mile radius.

870 State Street (11110-0175): The property was taken by the City for taxes on January 14, 2010. The parcel consists of two single story commercial buildings. Combined, these two buildings contain eight commercial units, of which three are currently occupied. (See photo).

E S Hayden Avenue (06460-0035): This property was taken for taxes on October 30, 2008. The lot is currently partially paved and is used for parking for an abutting residential property on Hayden Avenue, there is no formal agreement for this use is in place.

RESTRICTIONS AND REQUIREMENTS

For the full detail of all restrictions, descriptions, requirements, etc., please see "G. DEED RESTRICTIONS". Please note, the City plans to transfer title on the property with a deed restriction prohibiting future use of the subject properties as package stores or other establishments that sell alcoholic beverages.

DEVELOPMENT CONCEPT

The City is seeking to select the developer who submits the most advantageous proposal consistent with the selection criteria and proposal requirements set forth in this RFP, and who demonstrates the ability to perform as proposed in a timely fashion.


While the financial benefits (i.e., price paid for the property) of a proposal are important to the selection of a developer, the City will consider the broader fiscal and economic benefits to be realized from the redevelopment project to be important as well, and will consider all selection criteria. The City will not be obligated to select the proposer offering the highest price if another proposal better satisfies the selection criteria and other requirements of this RFP as a whole.

The City will be seeking proposals that re-develop and improve the commercial property at 870 State Street, and the abutting parking area located at E S Hayden Street in a manner that will create a location for businesses that will be a beneficial and positive addition to the neighborhood and the State Street Corridor. Any proposed development should complement and enhance the abutting properties.

The City will only consider proposals for the redevelopment of both properties as one project. Proposals that consist of the redevelopment of both parcels will be considered more advantageous than proposals that only address the development of a single parcel.

RESTRICTIONS

Proposers should review all publicly available documentation in regards to the property as the City makes no representations regarding restrictions on use for any proposal. The following information is provided as a convenience, and not meant to be comprehensive.

This deed shall also be subject to all easements and restrictions of record, if any, lawfully existing in, upon or over said land or appurtenant. Proposers should review and confirm any and all conditions.

The City plans to transfer title on the property with a deed restriction prohibiting future use of the subject properties as package stores or other stores that sell alcoholic beverages.

DEVELOPMENT CONDITIONS

• The property is being sold in as-is condition, and the designated developer will take responsibility for any and all environmental conditions upon transfer.

• The City will require a certificate of occupancy within 180 days of the transfer of property to the designated developer or the property will revert back to the City.

• Prior to property transfer, the designated developer will produce financial commitment documentation for the value of the project from its lenders and/or funding sources.

• Prior to closing, the designated developer will produce a detailed project schedule and final floor plans for the building.

• The Office of Planning & Economic Development will maintain a Site Plan approval of final landscaping/parking on-site plans. No tree removal or other landscaping or site plan alterations should be made prior to this approval.

PRICE PROPOSAL

The City will entertain all competitive bids for the property. Price will not be the only factor in selection, but proposers are encouraged to make the best financial benefit case possible to the city and selection committee

PRE-PROPOSAL ASSISTANCE

Open house will be held at 870 State Street & E S Hayden Avenue at the following time:

January 29, 2014 at 11:00 AM to 12:00 PM

Please note occupied units will not be available for viewing. Common areas and vacant units will be the only areas accessible during the designated times.

Those visiting the open house must sign an indemnification agreement prior to entering, and should be prepared with sturdy footwear and flashlights for each person entering the building. See "Attachment D-Indemnification Agreement".

In addition to the open house, questions regarding the RFP may be submitted in writing to the Office of Procurement. To maintain a fair and impartial competitive process, the City can only answer written questions. Private communication is not allowed with any RFP Review Committee Member during the proposal preparation and evaluation period. Proposers who initiate private communication or attempt to violate the process outlined herein may be disqualified. We will only respond to written questions.
