The City of Springfield is requesting proposals for the disposition and redevelopment of two (2) parcels on Walnut Street known as 200 Walnut Street and 206 Walnut Street. The total land area of the property is approximately 25,354 square feet (.58 acres). There is a small one story commercial building located on the parcel known as 200 Walnut Street and 206 Walnut Street is vacant.

The property is located in the Six Corners neighborhood with direct frontage onto Walnut Street. This property is being sold "as is," and the City makes no representations regarding environmental condition and will require the buyer to assume responsibility for these conditions.

Site Visit/Walk thru is scheduled for (10:00AM to 11:00AM)on February 26, 2014.

The City has not and does not make any representations or warranty as to any matter affecting or relating to the facilities, including but not limited to the physical condition thereof, and the selected developer acknowledges that no such representation or warranty has been made and agrees to take the facilities in "as is" condition. The City shall not be liable or bound in any manner by any statement, representation, information pertaining to the facilities which may have been furnished to the developer by any of the City's employees, attorneys, agents, servants, or other persons.

The property is located on Walnut Street in the Six Corners section of the City. The total land area of the property is approximately 25,354 square feet (.58 acres). There is a small one story commercial building located on the parcel known 200 Walnut Street and 206 Walnut Street is vacant. The building has been vacant for a number of years and appears to have significant deferred maintenance issues.

Development Concept

The City will favor all development proposals that will have a beneficial impact on the surrounding neighborhood and on the City of Springfield as a whole.

Restrictions and Requirements

The following uses are not allowed, and the property will be conveyed with a deed or leased with these restrictions prohibiting them in the future:

• Uses not allowed within Business A zoning;

• Non-accessory signs. In addition, there shall be no more than one (1) accessory ground sign; and

• Automotive related used (i.e. motor vehicle service stations, used cars sales, etc.).

In addition:

• The property will be conveyed with deed restrictions and a reverter clause which will require the development of the site within twenty four (24) months of conveyance of the deed.

• The lots will be required to be combined through the Approval Not Required (ANR) process.

• If a nonprofit organization is chosen as preferred developer, it will be expected to enter into an agreement with the City to make an annual in-lieu-of-tax payment and the amount will be negotiated with the Board of Assessors and/or the City Treasurer.

• Selected proposal will subject to all current Zoning, Code, City Ordinance, building restrictions and controls as well as complete site plan review and approval by the Office of Planning and Economic Development.

The City, in its sole and absolute discretion, with or without cause, and without liability of any kind to any Proposer, reserves the right to:

• Accept or reject any and/or all proposals, either in whole or in part, waive any informality of any proposals, cancel this RFP at any time and/or take any action in the best interest of the City. The City's decision in all matters shall be final;

• Retain all proposals for official record purposes, including a copy of the selected Proposer's proposal and supporting documentation, and/or use them in whatever manner it deems appropriate;

• Investigate the financial capability, integrity, experience and quality of performance of each Proposer including all major stockholders and principals;

• Request an oral presentation from any Proposer; and

• Request any additional information from any Proposer.

Environmental Issues

The City has not made and does not make any representation or warranty as to any matter affecting or relating to the property, including but not limited to the physical condition thereof, and the selected developer acknowledges that no such representation or warranty has been made and agrees to take the facilities in "as is" condition. The City shall not be liable or bound in any manner by any statement, representation, or information pertaining to the facilities which may have been furnished to the developer by any of the City's employees, attorneys, agents, servants, or other persons. The selected developer has had a fair and complete opportunity to inspect the property and accept it "as is" with no exception. The selected developer agrees to indemnify the City, and hold the City harmless, from all damages, losses, and liabilities (including without limitation attorneys' and experts' reasonable fees and disbursement) arising under federal and state environmental statutes and regulations as a result of or relating to any conditions or activities at or involving the facilities.

A Phase I, Environmental Site Assessment has been completed and has been attached to this RFP (see Exhibit B). Interested parties may also wish to contact the Massachusetts Department of Environmental Protection regarding potential liabilities under state environmental law.
