<title><![CDATA[RFP: Magazine Street Redevelopment Opportunity]]></title>

<description><![CDATA[Bid: 12-414 - The City of Springfield (hereafter \"CITY\") is requesting proposals for the redevelopment of two sites, totaling seven tax foreclosed parcels, located at Magazine Street, as more fully described in "Section D" - Location and site information" of this Request for Proposals (RFP). 

The Redevelopment Project site ("Project Site") includes two adjacent areas with seven separate parcels, situated on approximately 1.5 acre of land in the McKnight neighborhood of the city, and in immediate proximity to the campus of the Springfield Technical Community College campus, STCC Technology Park including a 300 employee Liberty Mutual office, the Albany Street industrial corridor, the new EcoBuilding Bargains Center for EcoTechnology, Merriam-Webster Headquarters, and the newly restored Worthington Commons housing development.   

Although the information regarding the property contained in the RFP is from sources deemed reliable, such information has not been verified and no representation is made or implied as to its accuracy.

The City will give  preference to developers whose proposal includes the purchase and redevelopment of both sites, including all seven parcels as a single project, but will also consider individual proposals for the two site packages separately divided and described in Attachment B as "Site A" and "Site B" 

MINIMUM FAIR MARKET PURCHASE PRICE IS $209,600:  SITE A IS $112,100.  SITE B IS $97,500.  Respondents may submit bids below the market value, but must provide a detailed explanation for the purpose.  The city reserves the right to reject all bids.

Springfield is located along the Connecticut River 25 miles from Hartford, Conn.; 50 miles from Worcester; 80 miles from Albany, N.Y.; 85 miles from Providence, R.I.; 90 miles from Boston; and 140 miles from New York City. 

Springfield has a notable history. It was the home of Theodore Geisel, better known as Dr. Seuss, and is the location of the Springfield Museum Quadrangle, which includes the Dr. Seuss sculpture garden. It is also the birthplace of basketball, invented by James Naismith at Springfield College, and home to the Naismith Memorial Basketball Hall of Fame. Other points of interest include the Springfield Armory National Historic Site, Springfield Symphony, CityStage, the Artists at Indian Orchard Mills complex, the Community Music School and many other arts and cultural attractions. The Springfield Museums, located on the State Street Corridor, house one of the most comprehensive collections of Currier & Ives prints in the world, and the G.W. Vincent Smith Art Museum at the Quadrangle holds one of the Western world's largest collections of Chinese cloisonné. The American Hockey League's Springfield Falcons franchise is based in Springfield, as is the league's headquarters. In March 2009, the City became one of only two in New England to be awarded a National Basketball Association Development (NBA-D) League franchise, known as the Springfield Armor. 

From its earliest beginnings Springfield had its roots in industry. In 1776, a national arsenal was sited within Springfield, and, in 1794, it was designated by Congress as the first National Armory. With the dawning of the Industrial Revolution, Springfield experienced growth across a spectrum of manufactured goods: handguns, railroad cars, motorcycles and cars. 

Beyond its distinctive historical roots, the City is home to four colleges: Springfield College, American International College (AIC), Western New England College and Springfield Technical Community College (STCC), with a combined enrollment of nearly 20,000 students. AIC and STCC are located on the State Street Corridor. AIC is located directly adjacent to the Project Site.  The City is engaged in an economic and cultural partnership with Hartford, Conn., and the Springfield-Hartford region constitutes New England\'s Knowledge Corridor, with the second-largest concentration of institutions of higher learning in New England, outside Boston. 
Major and prominent employers in the City include the world headquarters of MassMutual Financial Group - which is located on State Street; Liberty Mutual also on State Street; Baystate Health; Mercy Health System; Big Y World Class Markets; Peter Pan Bus Lines; Smith & Wesson; Milton Bradley and Merriam-Webster. Of special interest, Baystate Health, which already employs 3,800, has unveiled one of the more aggressive economic development projects in the region. Baystate Health recently completed a $296 million expansion in March, 2012, creating more than 500 jobs on the 54-acre Baystate Medical Center campus located in the North End of the city. Baystate is also the western campus of Tufts University School of Medicine.
Springfield is the third largest city in Massachusetts and fourth largest in New England (behind Boston, Providence, and Worcester).  Springfield is commonly known as the City of Homes for its vast stock and variety of historic architecture and housing styles, and as the City of Firsts for its being the home to many "firsts," such as the birth of basketball, the nation's first Armory, the first motorcycle, and the first gasoline-powered commercial car.

There are proposed plans to link downtown Springfield via frequent commuter rail service to Hartford, New Haven and points thereafter including New York City. These locales are already served by Amtrak rail, with daily trips from Springfield.  

LOCATION AND SITE INFORMATION 

The project sites are located in the McKnight neighborhood at Magazine Street. The properties are located in immediate proximity to the campus of the Springfield Technical Community College campus, STCC Technology Park including a 300 employee Liberty Mutual office, the Albany Street industrial corridor, the new EcoBuilding Bargains Center for EcoTechnology, Merriam-Webster Headquarters, and the newly restored Worthington Commons housing development, and less than one mile from MetroCenter.

Site A consists of three parcels and is approximately 35,797 square feet.  The site is primarily vacant and undeveloped.  A small retail storefront occupies less than 4,200 square feet on the site known as 143 Magazine Street (Parcel ID: 08110-0026).  Site B consists of three parcels and is approximately 28,966 square feet of undeveloped land.  Sites A and B are contiguous. Adjacent properties include the Mental Health Association and approximately 50,000 square feet of privately owned undeveloped land.

Proposers are encouraged to work with neighboring properties to ensure any development proposal contributes to improving the aesthetic streetscape of the neighborhood and cognizant of the needs of neighboring residents and institutions, as well as to examine and incorporate any improvements to public way infrastructure including sidewalks, lighting, and landscaping that may be a benefit to the neighborhood and the development

RESTRICTIONS AND REQUIREMENTS

All proposers shall be subject to all restrictions and controls as stipulated in applicable ordinances of the City of Springfield's and deed restrictions.

DEVELOPMENT CONCEPT

The City is seeking to select a developer who submits the most advantageous proposal consistent with the selection criteria and proposal requirements set forth in this RFP, and who demonstrates the ability to perform as proposed in a timely fashion. The City will give preference to developers whose proposal includes the purchase and redevelopment of both sites, including all seven parcels as a single redevelopment concept.  The city will also consider submitted proposals that develop one site independent of the other.

While the financial benefits (i.e., price paid for the property)  of a proposal are important to the selection of a developer, coupled with all selection criteria, the City will also consider the broader fiscal and economic benefits to be realized from the redevelopment project.  The City will not be obligated to select the proposer offering the highest purchase price if another proposal better satisfies the selection criteria and other requirements of this RFP as a whole.  

The City is most interested in proposals that creatively integrate both sites with the surrounding area, respecting zoning, and in a manner that creates a viable redevelopment opportunity and enhances the aesthetic appeal of the streetscape. Proposers should be familiar with abutting uses and mindful of such when developing a redevelopment project and program to ensure the project is respectful of existing neighbors and providing added value to the neighborhood.

PRE-PROPOSAL ASSISTANCE

The sites are open vacant land and are accessible for viewing from the street at anytime.  Attachment A includes an aerial and plot plan map of the sites.  
			
Questions regarding the RFP may be submitted in writing to the Office of Procurement. In order to provide prompt answers to questions, the City requests that all proposers submit written questions to the City of Springfield's, Office of Procurement not later than 4:00 p.m. June 7, 2012. The City will compile written answers which will be mailed to all Proposers who requested a copy of the RFP, no later than June 11, 2012.

To maintain a fair and impartial competitive process, the City can only answer written questions.  Private communication is not allowed with any RFP Review Committee Member or member of the Office of Planning and Economic Development or other city staff during the proposal preparation and evaluation period.  Proposers who initiate private communication or attempt to violate the process outlined herein may be disqualified.

<title><![CDATA[RFQ:  Legal Services for Projects related to proposed Casino Development and Community Impact]]></title>

<description><![CDATA[Bid: 12-369 - Through this Request for Qualifications (RFQ), the City of Springfield ("City") seeks outside counsel to provide legal advice and services related to the implementation of "An Act Establishing Expanded Gaming in the Commonwealth", codified at Chapter 194 of the Acts of 2011, including activities related to the development of a gaming facility within Western Massachusetts (Project), and any regulations promulgated by the Massachusetts Gaming Commission ("Commission") pursuant to the Act (collectively referred to herein as the "Act").   

The services include but are not limited to assisting the City in negotiating one or more host community agreements, negotiating one or more surrounding community agreements, and live entertainment venue mitigation agreements, setting up oversight procedures, advising the City as to permitting, construction, zoning and licensing issues related to the development and construction of a casino, determining the potential impacts of such a development and mitigation measures, etc.      
  
Proposals are sought from qualified firms with substantial experience in municipal legal affairs, representing municipalities, complying with gaming industry regulations, licensing, permitting, construction and land development administration. In addition, consideration will be given to proposals providing a team approach to the process so as to provide the City with negotiation skills and strategic advice related to the gaming industry, and the capacity to review engineering, economic, environmental, and other consulting reports that may become part of the process.

The City is particularly interested in engaging a firm with substantial experience in municipal law within the Commonwealth to aid the City in maximizing the benefits to the City and its residents through effective and thorough management of the casino development process from start to finish, in accordance with the Act.

The City reserves the option to award contracts to multiple Consultants but would prefer to award to a single Consultant which is able to provide all of the services requested.

The City intends to award a contract to the Firm which submits the most advantageous proposal, taking into consideration the qualifications in the Technical Proposal, and the Price Proposal. 


SCOPE OF SERVICES

The purpose of this contract is to engage outside counsel to advise the City regarding gaming facility development issues related to the implementation of the Act within the City of Springfield.  Counsel must have extensive experience in providing legal services related to the development of City infrastructure to support such a development as well as best methods of community mitigation.  Counsel must have a reputation for integrity, professionalism, intellectual rigor, and independence in its advisory roles.  
Positive references must be available from public sector clients for the specific types of services solicited. 

Illustrative examples of the types of services being procured include, but are not limited to, the following:

A thorough review and assessment of the Act, and any regulations issued thereunder, advice regarding compliance with the Act in regards to the components of a host community agreement, any surrounding community agreement/s, the referendum vote, and oversight and compliance monitoring of any applicant awarded a license to operate a casino in Springfield.    

1.	Assisting with the drafting and negotiating a host community agreement with the casino applicant, consistent with the requirements of the Act, and any surrounding community agreement/s if a license is awarded to a casino applicant in another Western Massachusetts community, and live entertainment venue mitigation agreements for Springfield Symphony Hall and CityStage, in accordance with Chapter 23K and the Act.       

2.	Assisting with any further procurements needed for the negotiation of the host community or surrounding community agreements; 

3.	Advising on issues related to the handling of competitively sensitive or other proprietary information that may be provided to the City; and

4.	Assisting with responding to relevant questions from City officials and representatives and other interested parties. 

B.	TASK ORDERS

1)	From time to time, the City, through its duly authorized representatives, will request that the successful Proposer perform certain services in furtherance of the activities described in the RFQ.   Each request will be in the form of a document authorizing the completion of certain Services, referred to as a "Task Order".  For each Task Order, the City and the successful Proposer will mutually agree on a detailed written description the Services to be performed by Consultant, including a task description, a maximum compensation amount, a proposed schedule for delivery of Services, the estimated number of hours to complete the task, and a list of the job titles and names of the members of the Firm and the Firm's team assigned to the task. Any Task Order must be in writing and approved and signed by the Firm's authorized designee, and either the City Solicitor, or the Chief Development Officer, or their authorized designees.   The Consultant shall not incur hourly charges or other expenses for a Task Order in excess of the approved lump sum amount without prior written approval from the designated officials.   The Consultant shall invoice the City only for actual time incurred to complete the work on a Task Order.       

2)	The Consultant will be responsible for tracking Task Order progress by regular (bi-weekly or monthly, as requested by the City) reports from the Consultant to the City that will include the following information: a) percent completion of task order, b) amount of fees invoiced to date, and c) amount of allotted time used.  Analysis and comparison of information in (a), (b) and (c) above against the Task Order budgets for these items will provide the monitoring information necessary to ensure successful performance and completion of Consultant's obligations.


3)  ADDITIONAL SERVICES: The City reserves the right to request additional services as provided in the RFQ.  When requested by the City, the Consultant shall provide, or as needed retain the services of, professional and technical experts to provide services which are not included within the job titles listed in the RFQ.  The Consultant shall obtain proposals from qualified third parties and recommend to the City for approval, which shall become part of the applicable Task Order.  No additional services shall be performed without prior City approval, including work by professional and/or technical experts.  Additional Services shall be considered a reimbursable expense to the Consultant, and shall be billed to the City at the rate agreed upon in the particular Task Order.

C.   ESTIMATED COSTS PER CONTRACT PERIOD: 

The City estimates the following as the not to exceed amounts for each fiscal year during the Contract term.    These amounts are estimates only, and may be affected by the timetable for casino development license applications and procedures once established by the Commission.  Funding for the contract in each City fiscal year (July 1st to June 30th) after the first fiscal year is subject to appropriation.    

July 1, 2012 - June 30, 2013:  Not to exceed $125,000.00
July 1, 2013 - June 30, 2014: Not to exceed $50,000.00
July 1, 2014 - June 30, 2015:  Not to exceed $50,000.00

Bidding procedures are per Massachusetts General Laws (M.G.L.) Chapter 30 section 39M. The conditions of employment and wage rates, as set forth by the Massachusetts Division of Occupational Safety shall prevail in the execution of the work under this contract.

In order for a bid to be deemed valid, the Contractor must be prequalified by the Massachusetts Department of Transportation in the specific class of work with a single contract limit at or above the dollar value of the project.

Estimated cost of the project: $2.7 million

Project Scope: Milling and paving of arterial and residential streets and the construction of concrete sidewalks, driveways and handicapped ramps.
