CITY OF SPRINGFIELD LAW DEPARTMENT TO ISSUE CEASE AND DESIST LETTER CLEMENTE’S BAR AND GRILL D/B/A LUX
April 8, 2014 -Springfield, MA- The City of Springfield Law Department (City) has issued a Demand to Cease and Desist to Clemente’s Bar & Grille, Inc. d/b/a LUX located at 90 Worthington Street after city officials learned of a planned event being promoted for April 26, 2014. The advertising for such an event offers offering reduced cover charges for women along with drink specials to patrons.
The letter issued by Assistant City Solicitor Stephen M. Reilly, Jr., stated that “M.G.L. c. 151B and the regulations promulgated thereunder prohibit discrimination based upon sex. This includes offering a reduced cover charge to women. In addition, 204 CMR 4.03 restricts offering drink specials to limited circumstances. The content of the enclosed advertisement indicates these circumstances are not present for the April 26, 2014 event. Moreover, distribution of advertising material of the type enclosed is a violation of City Ordinance, specifically Chapter 7.16.120.”
“We will continue to make sure pouring establishments are adhering to the law. We will not tolerate establishments that ignore state law and city ordinances,” stated Mayor Domenic J Sarno.
The letter has been addressed to Mr. Gabriel Reyes, Manager of Clemente’s Bar & Grill, Inc. d/b/a LUX . The notice states Failure to comply with this notice shall result in enforcement action by the City of Springfield which may include but not be limited to revocation of your alcohol license and/or entertainment license.
