June 14, 2011 – The Legal Division of the City of Springfield’s Office of Housing announced today that the City’s Code Enforcement Department is in the process of finalizing the condemnations in the areas of the City affected by the recent tornado, and the paperwork is being processed as quickly as possible. Residents should be aware that a condemnation order, does not in most instances, mean immediate demolition.
Owners of condemned properties should be aware that the City will file an action in the Western Division Housing Court as the next step in the process of dealing with the large number of condemned structures. Associate City Solicitor Lisa DeSousa stated, “court action can be confusing and frightening to people, but it is a necessary step in the condemnation process.” Recognizing structures were damaged through no fault of the property owners, Attorney DeSousa wants individuals to recognize this is not a criminal case, but rather is a civil matter.
The cases will allow property owners, displaced tenants and the city to meet in court to:
1. Explain the next steps;
2. Obtain information about relocation assistance as a displaced tenant or property owner; and
3. Obtain information to assist with insurance claims and learn about responsibilities to any tenants a property owner has as an owner of real estate under these circumstances.
Filing the Court action allows the City to ensure that insurance proceeds are dedicated to repairing or demolishing the property, as appropriate, and will prevent irresponsible property owners from pocketing the insurance proceeds and leaving the City to deal with the distressed property.
To assist individuals with navigating the court process, the Hampden County Bar Association has established a lawyer referral and informational service. Attorneys will provide free assistance in answering questions regarding legal rights, responding to any condemnation complaints and assisting individuals with insurance claims and related matters.
